Terms and Conditions

The terms and conditions below apply to all services provided by The Life Experience Collective LLC (“the event planner”, “the coach”, ”the group leader”, ”the pre-marital coach”, ”the wedding officiant”, “the therapist“, “the wellbeing manager”, “the speaker“), to any individual or organization (“the client”) and constitute the contract for the service to be provided by Kyndra Lina or another team member of The Life Experience Collective LLC for the client.

Coaching Disclaimer

In committing to life coaching with The Life Experience Collective LLC, you acknowledge the following:

  • You understand that the coaching services you will be receiving from your Coach are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions. You also understand that your Coach is not acting as a mental health counsellor or a medical professional. You understand that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment, and you will not use it in place of any form of therapy.

  • For legal purposes, you understand that coaching is currently an unregulated industry and that your Coach is not “licensed “ by any US body even though the sessions may take place in the United States.

  • You understand and agree that you are fully responsible for your well-being during your coaching sessions and subsequently, including your choices and decisions.

  • You understand that all comments and ideas offered by your certified Life Coach are solely for the purpose of aiding you in achieving the defined goals you create with your certified Life Coach. You have the ability to give your informed consent, and hereby give such consent to your certified Life Coach to assist you in achieving such goals and understand that results are not guaranteed.

  • You understand that to the extent our work together involves personal development, career or business, your certified Life Coach is not promising outcomes included but not limited to trauma recovery, personal introspection, increased personal happiness, career progression, profitability and/or business success.

The term ‘coaching’ as here used covers budget coaching, natural hair coaching, life transition coaching, vegan lifestyle coaching, time management coaching, personal development coaching, life coaching where applicable includes mentoring or supervision services provided for clients, or others.

In the spirit of good practice, when you are purchasing coaching services, please confirm that you have read and agreed to each statement below and that you wish to proceed.

All coaching services and communication, email or otherwise, delivered by your coach, as well as information on this website (www.TheLifeExperienceCollective.com) are meant to help you strengthen a specific area of your life. Coaching is not a substitute for professional mental health care or medical care.

The Life Experience Collective LLC is continually striving to ensure the standard of service provided to our clients remain excellent. At the end of the coaching process, or series of coaching sessions, the client will be asked to complete a feedback form.

Officiant Disclaimer

Officiant hereby agrees to render Virtual Wedding Officiant Services ("Services") for Client at the date, time and location as specified in this Agreement.

The "Ceremony Start Time" is considered the anticipated Start Time and not Guest "Arrival" or "Invitation" time. Client agrees that the Event shall begin within five (5) minutes of the "Ceremony Start Time" as specified in the Agreement.

Changes to this Agreement including, but not limited to the date, time, and/or location of the Event must be communicated in writing by Client and approved by Officiant in writing before it is confirmed. This process may cost an additional fee of one hundred and fifty ($150) dollars.

The full service fee must be paid at the time of booking, and all sales are final.

Fees are transferable to another date and time as long as Client requests change in writing at least seven (7) days prior to the Event date and Officiant is available. If Officiant is not available at the new date and/or time, the Client may continue to agree on a new date or cancel.

Cancellations must be communicated in writing. If written notice of Cancellation of Services is provided by Client up to twenty four (24) hours prior to the Event date, Officiant shall be released to make commercially reasonable attempts to re-book the date and time of the Event.

It is the Client's responsibility to acquire a valid marriage license, if applicable, in the state where the Event will take place and have the marriage license at the Event when the Services are rendered. Client agrees that failure to have a valid marriage license at the time of the Event means that the Officiant cannot legally perform the ceremony. Officiant will perform a symbolic ceremony, which will have no legal merit. If Client presents a Public Marriage License at least one witness must be present at the Event. Officiant will complete and sign the marriage license on the day of the Event and will return the completed marriage license by United States Postal Service First-Class mail or equivalent within two (2) business days to the county recorder of the county in which the license was issued. Client will not automatically receive a certified copy of their marriage license unless they request and pay for a certified copy from the County Clerk or County Recorder. In the event, the marriage license is not received by the county recorder; Officiant will cooperate with the Client and county recorder to resolve the issue. Cost for replacement license, if any, will be assumed by the Client. For privacy reasons, Officiant does not maintain copies of the marriage license.

If the Event includes a sand ceremony, unity candle, flower ceremony and/or any other special feature, Client is responsible for furnishing all equipment needed to perform such feature(s).

Client agrees that Officiant may use any images and stories from the Event for any means of promotion, including advertising and display on websites or blogs, unless otherwise stated by Client. Clients waive any right to payment, royalties or any other consideration for the use of the images or stories.

Officiant assumes no responsibility for injury, damages or losses incurred by the Client or event attendees. Officiant also assumes no responsibility for any food, beverage, floral arrangements, decorative items, either personal or professional, brought by anyone prior to, during, or after the Event. Client agrees to be responsible for all guests and attendees at the event and the acts of the guests and attendees. Client agrees to pay for any and all injury or damages arising out of the event, except to the extent of any negligence or misconduct by Officiant.

Clients agree that to the fullest extent permitted by law, Officiant shall not be liable for any claims for emotional distress, mental anguish, consequential damages, lost profit, loss of enjoyment, lost revenues, replacement costs, compensatory damages and/or punitive damages, whether or not foreseeable and/or arising from any negligent act or omission on the part of any person. Officiant's liability for any claim, breach or damage by reason of any act or omission shall be limited to repayment of sums paid by Clients only.

 

Data Protection

You understand that The Life Experience Collective LLC will protect your information as confidential unless you state otherwise in writing. If you report child abuse, elder abuse or neglect or threaten to harm yourself or someone else, you understand that necessary actions may be taken and your confidentiality agreement may be limited in this capacity. Furthermore, The Life Experience Collective LLC is ordered by a court to provide information or to testify, we will do so to the extent the law requires.

 

Data Security

You understand that the use of technology is not always secure and you accept the risks of confidentiality in the use of email, text, phone, Zoom, Voxer and any other technology.

 

Waiver

You hereby release, waive, acquit and forever discharge The Life Experience Collective LLC, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit action, demand or right to compensation for damages you may claim to have or that you may have arising out of acts or omissions by yourself or by The Life Experience Collective LLC as a result of the advice given by a member of our team or otherwise resulting from the professional relationship contemplated by this agreement.

You further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made to you to sign this agreement. This agreement shall bind your heirs, executors, personal representatives, successors, assigns, and agents.

 

Terms and Conditions

The meeting schedule for the service of your choice will be arranged between The Life Experience Collective LLC and the client and can be booked up to 3 months in advance. The Life Experience Collective LLC will recommend the frequency of each session based on a professional assessment of the client’s requirements. This recommendation, or plan, is not binding and may be altered and adjusted throughout the longevity of the service given by mutual agreement, in accordance with the terms set out in this agreement.

Where no specific number is agreed sessions will be provided on a session by session basis.

In return for the fees payable by the client (or by a third party on their behalf), The Life Experience Collective LLC agrees to provide the service as described below and in accordance with the terms and conditions set out below. The client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client).

The date that the first session takes place shall be deemed to be the start date for the service. Where any client is unhappy with any of the terms and conditions they can contact The Life Experience Collective LLC to discuss any concerns and see if they can be resolved before the first session. Participation by any individual in the first session constitutes acceptance of these terms and conditions.

 

Format of Sessions

Sessions, Events, and Ceremonies are held by Zoom. In all cases the client is responsible for being ready to meet at the agreed upon time. A team member from The Life Experience Collective LLC open to other formats by mutual agreement. A team member from The Life Experience Collective LLC is responsible for ensuring that they are available to meet at agreed times.
The length of each session set by the client at the time of booking on the appointment booking platform and paid for accordingly at the time of booking. Sessions may over-run by mutual agreement and paid for retrospectively, but only if the Coach has no commitments immediately following the session.

 

Session Fees

The Life Experience Collective LLC’s current fees are stipulated on the website and made clear at the time of booking. We reserve the right to change these from time to time. Any payments for services paid in advance are honored even if prices have risen between the point of booking and the time of session.

 

Dates and Times of Sessions

The date and time of the first session for the desired service and any subsequent session will be registered on the online agenda maintained on the website. The Life Experience Collective LLC agrees to maintain our availability to match that presented by the website, and to honor the sessions booked through the online bookings platform.

Sessions can only be rearranged in accordance with the section in these terms and conditions headed “Rearranging Sessions”.

 

Payment Terms

Fees can be paid online through the Payment Portal by debit or credit card, using the “Stripe” payments gateway linked to the online booking platform. Alternatively payments by standing order or by bank transfer may be made by mutual agreement.

Receipts and/or invoices are available, and where receipts are requested by the client, they will be sent by e-mail..

Fees are payable in advance of each session, event, or ceremony unless otherwise agreed. Where payment has not been received by The Life Experience Collective LLC in advance of a session, event, or ceremony The Life Experience Collective LLC is not obliged to provide the service.

Where payment is required on receipt of invoice rather than in advance, a charge may be levied for late payment.

 

Between Sessions

The Life Experience Collective LLC may assign the client tasks or exercises to complete between coaching or therapy sessions. There is no obligation on the client to complete these items of ‘homework’, but not doing so may slow the client’s progress in gaining improved quality of life or achieving desired personal outcomes.

The client may contact The Life Experience Collective LLC by email between sessions to seek clarification regarding anything arising from a coaching or therapy session or for administrative purposes (e.g. where a client needs to rearrange a coaching session or make a payment). Additional coaching or therapy can also be provided between sessions but there will be an additional charge for this. The Life Experience Collective LLC will always advise a client in advance if the nature of a client’s contact is likely to incur an additional charge and no such charges will be imposed without the client’s agreement.

 

Rearranging Sessions/Ceremony/Event

If a client needs to rearrange a session, ceremony, or event they should provide at least 48 hours notice. No refunds will be given to clients for unused coaching or therapy sessions. In exceptional circumstances The Life Experience Collective LLC may need to rearrange a session, ceremony, or event. In those instances we will also give the client 48 hours notice where practical.

Where a client pays for a session or sessions in advance they must have the coaching session(s) that they have paid for within 6 months of the payment or their fee is forfeited.

 

Confidentiality

Personal information or business information supplied by clients in coaching sessions will be treated as confidential. It will not be disclosed to a third party without the client’s prior permission, save where required by law or where action might be necessary to prevent harm to the client or someone else.

 

Early Termination

In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behavior by the client, actual or potential conflict of interest, or other reasons, The Life Experience Collective LLC can decide to terminate the service to the client early or refuse or be unable to provide further service to the client. In such a circumstance the client will be given reasonable notice of termination by The Life Experience Collective LLC where practicable and may be refunded any advance payments made for coaching sessions not yet provided based on The Life Experience Collective’s discretion.

 

Responsibilities

The Life Experience Collective LLC will seek to enable the client to improve their quality of life success and to achieve their desired outcomes. Remarkable results can be achieved where clients follow a clear plan in a committed way. However, the client has sole responsibility for taking important decisions in their life. The Life Experience Collective has no liability for any loss incurred by any client, whether financial or otherwise, following commencement of services, or for any perceived failure by the client, whether justified or otherwise, to achieve a material improvement in trauma recovery, quality of life, career or business or to achieve their desired outcomes or goals.

 

Variation of Terms and Conditions

Where an initial number of sessions is agreed, any changes to these terms and conditions intended to take effect prior to the conclusion of those initial number of sessions will only have effect if agreed by both The Life Experience Collective LLC and the client and confirmed by The Life Experience Collective LLC in writing by email or letter. In other cases, The Life Experience Collective LLC may change any of these terms or conditions including the Per Session Fee by giving the client one week’s notice in writing by letter or e-mail of the change(s). If following receipt of such notification of change, the client no longer wishes to proceed with further services, they may withdraw from the service immediately by giving notice in writing by email or letter but will not receive a refund for any fees paid in advance for servicess not yet provided. Such notice will be effective on receipt by The Life Experience Collective LLC. All fees are paid up front and all sales are final.

 

Governing Law

This contract is governed by the law of Georgia whose courts have exclusive jurisdiction in relation to any dispute, disagreement, proceedings or legal claim of any nature relating to the service provided or the contract.

 

Feedback

Feedback about the service is welcomed and can be given during a coaching session or the contact form on the www.TheLifeExperienceCollective.com website.
